Terms of Service

1. Agreement to Terms

These Terms of Service (the “Terms”) govern your access to and use of the Figtional website, personalisation flow, and related services (the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Who We Are

Figtional is operated by Figtional Partnership, a general partnership based in Toronto, Ontario, Canada. Contact us at[email protected]. These Terms are governed by the laws of the Province of Ontario and the laws of Canada, as described in Section 14.

3. Eligibility

You must be able to form a binding contract in your jurisdiction to use the Services. Our site is intended for parents/guardians; children under 13 should not use the Services without adult supervision.

4. Accounts

Account creation is optional. If you create an account, you agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account. We may suspend or terminate accounts for suspected fraud, abuse, or violations of these Terms.

5. Personalisation Content

To create your personalised book, you may provide a child’s name, chosen pronouns, dedication, and photo(s). You grant Figtional a limited, non‑exclusive, worldwide license to use, reproduce, modify, and transform that content solely to provide and improve the Services (including order production, reprints, customer support, and necessary backups). You represent that you have the rights and permissions to provide this content.

You agree not to submit content that is unlawful, harmful, infringing, defamatory, or otherwise objectionable, and you agree not to submit content belonging to others without authorization. We may refuse or cancel orders that violate these requirements.

6. Orders, Pricing, and Taxes

  • Prices are shown in CAD or USD depending on locale and are subject to change. Any applicable taxes and shipping fees are shown at checkout.
  • We strive to display information accurately, but occasional errors may occur. We may cancel or refuse orders placed for products listed with incorrect pricing or availability.
  • Color and print variations can occur due to printing processes and screen differences; such minor variations are not considered defects.

7. Payments

Payments are processed by Stripe. We do not store your full credit card details. By submitting a payment, you authorize us (and our payment processor) to charge your payment method for the total amount shown at checkout. Chargebacks that are determined to be fraudulent or abusive may result in account suspension.

8. Shipping and Delivery

We ship worldwide with primary operations in Canada and the United States. Delivery estimates are provided at checkout and may vary by destination and carrier. Risk of loss passes to you upon delivery by the carrier.

9. Cancellations, Returns, and Refunds

Because your book is custom‑made, cancellations may only be possible before printing begins. Once production starts, orders are generally non‑cancelable and non‑refundable. If your order arrives damaged, is defective, or there is a printing error, we will replace it. For details, see ourReturn Policy.

10. Intellectual Property

All story templates, artwork, software, and brand assets are owned by Figtional and protected by intellectual property laws. When you purchase a book, you receive a personal, non‑transferable license to use that book for non‑commercial purposes. You may not copy, reproduce, modify, distribute, or resell our content or attempt to reverse‑engineer our systems.

11. Acceptable Use

  • Do not use the Services for unlawful purposes or to violate rights.
  • Do not interfere with or disrupt the Services or networks.
  • Do not scrape, crawl, or harvest data without authorization.
  • Do not attempt to access non‑public areas or systems.

12. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. Some jurisdictions do not allow disclaimers of certain warranties; in such cases, the disclaimer applies to the maximum extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law, Figtional and its partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. Our total liability for any claim relating to the Services is limited to the amount you paid to Figtional for the order giving rise to the claim.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the laws of Canada. Any disputes shall be resolved in the provincial or federal courts located in Toronto, Ontario, Canada, and you consent to their jurisdiction and venue.

15. Changes to the Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
